The Dharwad Bench of the High Court, led by Justice M. Nagaprasanna, ruled that the government cannot curtail the fundamental rights guaranteed under Articles 19(1)(A) and 19(1)(B) of the Constitution, which protect the freedom of speech, expression, and peaceful assembly. The order in question made it mandatory for private organizations to obtain prior permission to conduct events or programs in government premises. The court observed that imposing such restrictions would amount to a violation of Article 32 of the Constitution. Granting an interim stay on the government directive, the court adjourned the next hearing to November 17.
