तमिलनाडु हाई कोर्ट ने तीसरे बच्चे पर मातृत्व अवकाश मंजूर करने का आदेश जारी किया

B. Mangaiyarkarasi, an employee working in the Madras High Court, had filed a petition seeking maternity leave for her third delivery. While hearing the case, the Division Bench comprising Justice R. Suresh Kumar and Justice Shamim Ahmed noted that the Tamil Nadu Government’s Fundamental Rules state that maternity leave cannot be granted for a third childbirth. However, the Supreme Court has ruled that maternity leave must be granted for a third childbirth. Citing this, the High Court also reiterated that maternity leave should be granted for a third delivery and directed the Registrar of the High Court to grant the petitioner one year of leave along with all eligible monetary benefits. To prevent future litigation seeking maternity leave, the judges directed the Chief Registrar of the High Court to issue a circular regarding this order to all District Court Registrars and officials. They further instructed that the Chief Secretary of Tamil Nadu should be advised to ensure implementation of the Supreme Court and High Court orders, and that copies of this order be forwarded to all department secretaries and heads of departments.
